APPLICATIONS FOR ZONING BY-LAW AMENDMENT (ZBA-06-2020)

Purpose and Effect of the Applications:
The Municipality is seeking input on a development application within 120 metres of your property. The application would consider the re-zoning of the subject property from ‘Hamlet Residential First Density exception 1 (HR1-1)’ to a site-specific ‘Highway Commercial exception # (C2-#)’ zone. The effect of this zoning by-law amendment application would permit the use of a self storage establishment and all other uses within the Highway Commercial (C2) zone. In addition, the amendment would recognize a minimum of seven parking spaces, reduced front yard setback of 13.4 m (44 ft) from Gold Creek Drive and reduced side yard setback of 7.2 m (23.6 ft) from Egremont Drive.
The existing vacant lot abuts Gold Creek Drive and Egremont Drive and is approximately 0.4 ha (1.0 ac) in area. The zoning by-law amendment would permit the development of two 1-storey self storage buildings with a total area of 1296 m2 (13, 950 ft2) which includes an office space, meeting room and washrooms. The proposed buildings will be oriented parallel to Egremont Drive in an east-west manner. They will be setback a minimum of 6.1 m (20 ft) from the abutting agricultural lands to the south, and 10.1 m (33.1 ft) from the existing residence located east of the subject property. Seven parking spaces will be provided along the north portion of the site adjacent to Egremont Drive and one entrance will be provided from Gold Creek Drive using an existing driveway entrance. The proposal includes chain-link fencing around the west, north and southern lot lines. Woodboard fencing and a cedar hedgerow is proposed on the east lot line abutting the residence. No outdoor storage of property (e.g. vehicles, boats) is proposed. The proposal will also be subject to site plan approval.
Description and Location of Subject Land
The subject property, 10835 Gold Creek Drive, is located on the south-east corner of Gold Creek Drive and Egremont Drive. The subject property is legally described as Concession 4 N, Part Lot 12, Plan MRD 108 Part 1 Pt RP 33R2433 Part 1 (geographic Township of Lobo), Municipality of Middlesex Centre.

What can I expect at the Public Meeting?
The public meeting is an opportunity for members of the public to learn more about the proposed development. Attendees have the opportunity to hear a brief presentation about the development, ask questions, and/or make statements either in favour of, or in opposition to the development.
The public meeting will take place at a Council meeting and the chair will keep the meeting in order and allow the applicant (or their development team), the public, and Council to speak and ask questions.
Why is this Public Meeting being held and what are your rights?
Within Ontario, the planning and development process is open and transparent, where opinions from all individuals and groups are welcomed. By law, municipalities must hold a public meeting. This meeting is one of your chances to learn about the development proposal and offer your opinions.
Under the legislation governing this development process, which is Section 34 of the Planning Act, you have the following rights:
- Any persons may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Zoning By-law Amendment.
- If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipality before the Zoning By-law Amendment is approved or refused;
a --the person or public body is not entitled to appeal the decision of the Municipality of Middlesex Centre to the Local Planning Appeal Tribunal,
b --the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Board, there are reasonable grounds to do so.
- If you wish to be notified of the decision of Council of the Municipality of Middlesex Centre on the proposed Zoning By-law Amendment, you must make a written request to the Planning Division of the Municipality of Middlesex Centre at 10227 Ilderton Road, Ilderton, ON N0M 2A0.
In accordance with Section 34(10.4) of the Planning Act, R.S.O. 1990, c. P.13, as amended, the Municipality of Middlesex Centre has deemed this application to be complete for the purposes of Section 34(10.1) and (10.2) of the Planning Act.
